Curasol Terms of Service

Welcome to Curasol. These Terms of Service ("Terms") govern your access to and use of the website located at www.shopcurasol.com (the "Site") and the purchase of any products offered through the Site (collectively, the "Services").

BY ACCESSING THE SITE, PLACING AN ORDER, OR USING ANY SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE OR PURCHASE PRODUCTS.

These Terms include a binding arbitration clause and class action waiver in Section 17. Please read carefully.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Services or purchase products. By placing an order, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

We do not knowingly sell to, ship to, or collect information from persons outside the United States. Orders placed from outside the United States will be canceled.

2. Products and Dietary Supplement Disclaimers

2.1 Nature of Products

Curasol products are dietary supplements. They are not drugs, medicines, or medical devices.

2.2 FDA Disclaimer

These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

2.3 No Medical Advice

Nothing on the Site, in any marketing material, or in any communication from Curasol constitutes medical advice. Information provided is for general educational purposes only. You should consult a licensed healthcare professional before starting any supplement regimen, especially if you are pregnant, nursing, taking medication, have a medical condition, or are under 18.

2.4 Individual Results

Individual results vary. Any testimonials, reviews, or before/after representations reflect the experience of individual customers and are not a guarantee that you will achieve the same or similar results.

2.5 Allergens and Sensitivities

You are responsible for reading the full ingredient list before purchase. Curasol is not liable for allergic reactions or sensitivities. If you experience an adverse reaction, discontinue use immediately and consult a medical professional.

3. Orders, Pricing, and Payment

3.1 Order Acceptance

All orders are subject to acceptance by Curasol. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to orders that appear fraudulent, are placed by resellers, exceed reasonable personal use quantities, or contain pricing or product errors.

3.2 Pricing

All prices are in U.S. Dollars and are subject to change without notice. Prices displayed at checkout are final. We are not responsible for typographical, pricing, or product information errors and reserve the right to correct any such errors and cancel any affected orders, even after order confirmation.

3.3 Payment

You authorize Curasol and its payment processors to charge your provided payment method for the total amount of your order, including applicable taxes and shipping. You represent that you are authorized to use the payment method provided.

3.4 Taxes

You are responsible for all applicable sales, use, or similar taxes. Taxes will be calculated and added at checkout based on the shipping address.

3.5 Promotions and Discount Codes

Promotional codes, discounts, and offers are subject to specific terms, may be limited in time or quantity, cannot be combined unless explicitly stated, are non-transferable, and have no cash value. We reserve the right to modify or cancel any promotion at any time.

4. Shipping

4.1 Shipping Locations

We ship only within the 50 United States. We do not currently ship to U.S. territories, APO/FPO addresses, or international destinations.

4.2 Shipping Times

Estimated shipping times are provided as a courtesy and are not guaranteed. Delays due to carriers, weather, holidays, fulfillment volume, or events outside our control are not our responsibility.

4.3 Risk of Loss

Title and risk of loss for products pass to you upon delivery to the carrier. Lost or stolen packages after confirmed delivery are not the responsibility of Curasol. If a package is marked delivered but you have not received it, please contact the carrier first.

4.4 Address Accuracy

You are responsible for providing an accurate shipping address. Orders returned to us due to incorrect addresses, refused delivery, or failed delivery attempts may be subject to additional shipping fees to resend or may be canceled with a refund less the original shipping cost and a $20 processing fee (see Section 5).

5. Returns and Refund Policy

5.1 90-Day Satisfaction Guarantee

We offer a 90-Day Satisfaction Guarantee on eligible first-time orders. If you are not satisfied with your purchase, you may request a return within 90 days of the original delivery date, subject to the conditions below.

5.2 Eligibility for Return

To be eligible for a return: (a) the product must be unopened, unused, and in original sealed condition with all packaging intact — opened, used, or tampered-with products are not eligible; (b) the request must be submitted in writing to soporte@shopcurasol.com within 90 days of the delivery date; (c) the return must include the original order number and proof of purchase; (d) only the first order or first shipment in a subscription cycle is eligible; (e) bulk and promotional bundles may be returned only in full.

5.3 Return Process

Approved returns must be shipped to the address provided by our customer support team. The customer is responsible for all return shipping costs. We recommend using a trackable shipping method.

5.4 Refund Amount

Approved refunds will be issued to the original payment method, less a $20 per-order processing fee. Original shipping charges are non-refundable.

5.5 Processing Time

Once received and inspected, approved refunds will be processed within 7–14 business days. Banks may take an additional 5–10 business days.

5.6 Damaged or Defective Products

Contact us at soporte@shopcurasol.com within 7 days of delivery with your order number and clear photos. We will replace the affected item at no cost.

5.7 Non-Returnable Items

Opened or used products; products purchased through third-party retailers; free gifts, samples, or promotional items; subscription shipments beyond the first; orders outside the 90-day window; orders without proof of purchase.

5.8 Refusal of Returns

Curasol reserves the right to refuse any return that does not meet these criteria.

5.9 Abuse of Return Policy

We reserve the right to refuse service, cancel orders, or deny refunds to customers who abuse the return policy.

6. Subscriptions and Auto-Refill

6.1 Subscription Enrollment

If you select an auto-refill or subscription option, you authorize Curasol to automatically charge your payment method and ship a new order at the interval you selected until canceled.

6.2 Pricing

Subscription pricing reflects the discount displayed at checkout. We reserve the right to change subscription pricing with reasonable notice.

6.3 Cancellation

You may cancel your subscription at any time through your account or by emailing soporte@shopcurasol.com. Cancellations requested after a charge has been processed will apply to the next billing cycle.

6.4 Failed Payments

If your payment method fails, we may pause your subscription, retry the charge, or cancel the subscription at our discretion.

6.5 Subscription Refunds

Only the first shipment in a new subscription is eligible for the 90-Day Satisfaction Guarantee. Subsequent shipments are non-refundable.

7. Chargebacks and Disputes

7.1 Contact Us First

If you have any issue with your order, you agree to contact soporte@shopcurasol.com before initiating a chargeback or payment dispute.

7.2 Fraudulent Chargebacks

Filing a chargeback for a legitimate, delivered order without first attempting to resolve the issue may be considered fraudulent. We reserve the right to dispute the chargeback, refer to collections, permanently ban the customer, and pursue legal action.

7.3 Account Suspension

Customers who initiate chargebacks may have their accounts suspended.

8. Intellectual Property

8.1 Ownership

All content on the Site is owned by or licensed to Curasol and protected by U.S. and international intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only.

8.3 Restrictions

You may not copy, reproduce, modify, distribute, or republish any Site content without our prior written permission; use our trademarks for any commercial purpose; scrape, data-mine, or use automated tools; reverse engineer; or use the Site to develop a competing product.

8.4 User Submissions

If you submit any content to us, you grant Curasol a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute that content in any media for any purpose.

9. Prohibited Conduct

You agree not to use the Site for any unlawful purpose, misrepresent your identity, resell products without authorization, interfere with the Site's operation, transmit harmful code, harass others, or engage in fraudulent activity.

10. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

11. Third-Party Links and Services

The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party site.

12. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, Curasol disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement, and makes no guarantee that any product will produce any specific health outcome.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CURASOL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. Our total aggregate liability shall not exceed the amount you paid to Curasol in the three (3) months preceding the event, or one hundred dollars ($100), whichever is greater.

14. Indemnification

You agree to defend, indemnify, and hold harmless Curasol from any claims arising from your use of the Site or products, your violation of these Terms, your violation of any third-party right, false information you provided, or any adverse health event from use outside the recommended dosage.

15. Termination

We may terminate or suspend your access to the Site at any time, without notice, for any reason, including breach of these Terms.

16. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

17. Dispute Resolution — Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

17.1 Informal Resolution

Before filing any formal claim, you agree to first contact us at soporte@shopcurasol.com and attempt to resolve the dispute informally for at least 60 days.

17.2 Binding Arbitration

Any dispute shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Sheridan, Wyoming, or via remote proceedings.

17.3 Class Action Waiver

YOU AND CURASOL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

17.4 Exceptions

Either party may bring an individual action in small claims court or seek injunctive relief in court for IP infringement.

17.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to soporte@shopcurasol.com within 30 days of first accepting these Terms.

17.6 Severability of Arbitration Provisions

If any portion is found unenforceable, the remainder shall remain in effect, except that the Class Action Waiver shall not be severable.

18. General Provisions

These Terms constitute the entire agreement between you and Curasol. If any provision is found invalid, the remaining provisions shall remain in full force and effect. We may modify these Terms at any time with notice on the Site.
